Terms & Conditions
These terms cover your use of this website. They are not the agreement that governs design work we do for clients.

The short version: you're welcome to browse, read, and share this site. The designs and images belong to us or to our clients, so don't republish them as your own. Anything you send us through the enquiry form isn't confidential unless we've signed something saying it is, so please don't send us secrets. Nothing here is a guarantee about what a project will cost or achieve.
1. Agreeing to these terms
By using thecreativecoefficient.com you accept these terms. If you don't accept them, please don't use the site. We may update them from time to time; the date at the top shows the current version, and continuing to use the site after a change means you accept the updated terms.
2. Who we are
Creative Coefficient is an industrial design and product development consultancy with studios in Calgary, Alberta, Canada and Newcastle, New South Wales, Australia.
3. Using this site
You agree not to:
- Use the site for any unlawful purpose, or in a way that could damage, disable, or impair it.
- Attempt to gain unauthorised access to any part of the site or its underlying systems.
- Scrape, harvest, or systematically extract content or contact details, including for the purpose of training machine learning models or assembling marketing lists.
- Submit false information, impersonate someone else, or use the enquiry form to send unsolicited commercial messages.
4. Our content and our clients' content
All content on this site — text, photography, product renderings, case studies, layout, and the Creative Coefficient name and logo — is owned by us or used with permission, and is protected by copyright and trade mark law.
Much of the work shown belongs to the clients who commissioned it. Product names, marks, and images appearing in our portfolio remain the property of those clients and are shown to illustrate our involvement, not to claim ownership. Some projects we have worked on are absent from the portfolio because they remain confidential.
You may view, print, and share pages for your own reference or to evaluate us as a supplier. You may not reproduce, republish, sell, or use our content commercially, or present our work as your own, without written permission.
5. Anything you send us
This section matters more than the rest, so please read it. We are a design consultancy, which means we are regularly shown product concepts, and we work simultaneously across consumer, medical, industrial, and commercial markets. It is entirely possible that we are already working on something that resembles an idea you send us, or will be asked to in future.
- Information you submit through this website is not confidential and is not subject to any obligation of secrecy on our part, unless and until we have signed a written confidentiality or non-disclosure agreement with you.
- Sending us an idea creates no partnership, joint venture, employment, or fiduciary relationship, and no obligation to review it, respond to it, keep it, return it, or compensate you for it.
- We are free to continue developing our own work and our other clients' work, including in the same product category, without that constituting any use of what you sent.
- You confirm that anything you send is yours to send and doesn't breach anyone else's rights or an agreement you're bound by.
None of this is us trying to acquire your ideas. It is the opposite: we are telling you plainly not to disclose anything sensitive through a web form, so that neither of us ends up in an argument about who thought of what. Send us enough to start a conversation. We will happily sign an NDA before you send anything more, and for most projects we suggest it. Just ask us.
6. No professional advice, no guarantees
The content on this site is general information about our services and our past work. It is not engineering, regulatory, manufacturing, or legal advice, and it should not be relied on as the basis for a technical or commercial decision. Outcomes described in case studies were achieved in specific circumstances with specific clients and are not a prediction of what your project will achieve.
Any figures, timelines, or costs mentioned are illustrative. Nothing on this site is an offer, and no quotation is binding until set out in a signed proposal or contract.
7. Availability
We aim to keep the site available and accurate, but we provide it on an “as is” basis. We don't warrant that it will be uninterrupted, error-free, or free of harmful components, and we may change or withdraw any part of it without notice.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of this site, including lost profits, lost business, or lost data. Our total liability arising from your use of this site is limited to CAD $100.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded. In particular, if you are in Australia, nothing here excludes rights you have under the Australian Consumer Law, and if a guarantee under that law applies, our liability is limited to resupplying the relevant service or paying the cost of doing so, where the law permits that limitation. If you are in Canada, nothing here affects rights you have under applicable consumer protection legislation.
9. Links to other sites
We link to third-party sites, including industry directories and our clients' own pages. We don't control them and aren't responsible for their content, accuracy, or privacy practices. A link is not an endorsement.
10. Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
11. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have non-exclusive jurisdiction over any dispute, which means we may bring a claim there and you may also bring one in the courts of your own jurisdiction where the law gives you that right.
